Partner Visa Requirements

The Australian partner visa program allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia temporarily and eventually permanently.

In order to be eligible for a Partner visa, you must be in a genuine, ongoing, exclusive relationship and be able to sufficiently evidence this.

You need to be married or in a de-facto relationship for at least 12 months. If your relationship started less than 12 months ago, you can provide a registered relationship certificate instead.

Depending on whether you are in or outside Australia at the time of applying, there are different subclasses available (see below)

Partner Visa From Within Australia

The subclass 820 Partner visa is a temporary onshore partner visa that allows you to stay in Australia while your permanent subclass 801 Partner visa is processed.

The subclass 309 Partner visa is a temporary offshore partner visa that, once approved, allows you to travel to Australia and apply for a permanent subclass 801 partner visa at a later date.

The Subclass 300 Prospective Marriage visa is a temporary visa allowing the visa holder to travel to Australia for 9 to 15 months to marry their fiancé.

As part of your application you need to satisfy the delegate that your relationship is ongoing and exclusive, demonstrating past and current commitment, and future plans. Evidence can vary greatly depending on your circumstances - another reason you should hire an agent.
