Partner Visa Requirements
The Australian partner visa program allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia temporarily and eventually permanently.
In order to be eligible for a Partner visa, you must be in a genuine, ongoing, exclusive relationship and be able to sufficiently evidence this.
You need to be married or in a de-facto relationship for at least 12 months. If your relationship started less than 12 months ago, you can provide a registered relationship certificate instead.
Depending on whether you are in or outside Australia at the time of applying, there are different subclasses available (see below)
Partner Visa From Within Australia
The subclass 820 Partner visa is a temporary onshore partner visa that allows you to stay in Australia while your permanent subclass 801 Partner visa is processed.
Subclass 820 Temporary
Key Requirements:
- Be in Australia at the time of application
- Be married or in a de-facto relationship
- Be sponsored by your partner or spouse
- Stay in Australia during processing
Subclass 801 Permanent
Key Requirements:
- Be in Australia at the time of application
- Continue to be in the same relationship
- 2 years has passed since 820 lodgement
- Remain in Australia indefinitely
Partner Visa From Outside Australia
The subclass 309 Partner visa is a temporary offshore partner visa that, once approved, allows you to travel to Australia and apply for a permanent subclass 801 partner visa at a later date.
Subclass 390 Temporary
Key Requirements:
- Be outside Australia at time of application
- Be married or in a de-facto relationship
- Be sponsored by your partner or spouse
- Move to Australia once approved
Subclass 100 Permanent
Key Requirements:
- Be in or outside Australia at time of application
- Continue to be in the same relationship
- 2 years has passed since 820 lodgement
- Remain in Australia indefinitely
New Zealand Citizen Family Relationship Visa
The subclass 461 visa allows family members of New Zealand citizens who are living in Australia on a Special Category visa (subclass 444) to stay and work in Australia temporarily for up to 5 years. This visa is a valuable option for non-New Zealand citizens who are the partner or dependent child of a New Zealand citizen residing in Australia.
This visa supports family unity for New Zealanders living in Australia and gives their non-NZ family members the opportunity to live and work in Australia long-term without needing a separate work visa.
Prospective Marriage Visa Outside Australia
The Subclass 300 Prospective Marriage visa is a temporary visa allowing the visa holder to travel to Australia for 9 to 15 months to marry their fiancé.
Subclass 300 Temporary
Key Requirements:
- Be outside Australia at time of application
- Met your fiancé in person since turning 18
- Marry your fiancé before visa expiry
- Apply for onshore partner visa before visa expiry

Pillar 4: Commitment
As part of your application you need to satisfy the delegate that your relationship is ongoing and exclusive, demonstrating past and current commitment, and future plans. Evidence can vary greatly depending on your circumstances - another reason you should hire an agent.
