In order to be eligible for a Partner visa, you must be in a genuine, ongoing, exclusive relationship and be able to sufficiently evidence this.
You need to be married or in a de-facto relationship for at least 12 months. If your relationship started less than 12 months ago, you can provide a registered relationship certificate instead.
Depending on whether you are in or outside Australia at the time of applying, there are different subclasses available (see below)

Proving Your Relationship is Genuine
Don’t leave your future to chance. Save time and avoid doubt with the expert guidance of a friendly Registered Migration Agent.
Why you should invest in a supportive agent
A significant part of any Partner visa 820 and 309 or Prospective Marriage visa application is demonstrating the authenticity of your relationship through a wide range of documentary evidence. As your Registered Migration Agent, we will step you through the entire process, giving you feedback on the evidence you have and suggesting ways to strengthen your application.
Each relationship is different so we work closely with you to ensure your evidence is detailed and compelling. Although no agent can ever guarantee an outcome, we will assess your case based on your individual circumstances and highlight any issues or points that need strengthening to give you the best possible chance at success.
Pillar 1: Financial Aspects
Evidence of joint financial commitments is important to demonstrate that your relationship is genuine and continuing. Evidence may include joint bank accounts, joint liabilities, property ownership, among other things.
Pillar 2: Social Aspects
This pillar assesses the acknowledgement of the relationship within your social circle and the wider community. Evidence should include photos and documents that confirm public knowledge of your relationship, such as social media and recreational activities.
Pillar 3: Nature of the Household
It is important to sufficiently evidence the living arrangements of the couple to demonstrate that you are living in a shared household and not leading separate lives on a permanent basis. Evidence should include statements, evidence of your address and more.
Pillar 4: Commitment
As part of your application you need to satisfy the delegate that your relationship is ongoing and exclusive, demonstrating past and current commitment, and future plans. Evidence can vary greatly depending on your circumstances - another reason you should hire an agent.
This is a general overview of the citizenship application process. Individual circumstances, processes and requirements vary. We recommend that you seek the advice and support of a Registered Migration Agent.
Same-Sex Couples
We have helped numerous same-sex couples achieve their dreams of obtaining a Partner visa 820 or 309 and going on to live together in Australia permanently.
Australia legally recognises same-sex marriages and relationships, including for the purposes of all Partner and Prospective Marriage visas. Whether you are in a same-sex de facto relationship, you are married or engaged to be married, the gender or sex of your partner or spouse does not exclude you from being eligible for a Partner visa or Prospective Marriage visa.
We welcome and support same-sex couples with dignity, understanding and the same high level of service because everyone deserves to love and be loved.
